Defective Roads
On any road in any state across the U.S., you can find potholes, ruts or erosion that can make driving that road seem like an obstacle course. The control and maintenance of any road is determined by the type of road and can be the local municipality or the state. That governing body has a legal responsibility to provide byways that are well maintained and free of dangerous or defective conditions that might cause harm to the general public.

Construction Zones
As defective roads are scheduled for repair or new roads are being built, construction zones are established on or along side the road. Unfortunately, these areas can also be dangerous. Crews performing the construction work can be at as much risk from improperly marked work areas as the passing vehicles. For example, if lanes are not properly marked off, a driver may misread the signage and drive into the wrong area hitting a construction worker.
Drivers are still responsible for their own actions. Anyone operating a motor vehicle must be alert and aware of the area in which they are driving. They should not exceed speeds appropriate for the type of traffic they are in.
